Intellectual property in ASEAN

Intellectual property rights are gaining importance in ASEAN countries. The ASEAN Intellectual Property Action Plan 2016-2025 provides for the strengthening of intellectual property offices, the development of regional platforms, an inclusive IP ecosystem and the promotion of asset creation. Around 75% of the plan has already been implemented. Future priorities include harmonizing intellectual property rights, supporting SMEs in the commercialization of intellectual property and promoting cooperation in the areas of genetic resources, traditional knowledge and cultural expressions.

In August 2023, the ASEAN IP Register was launched, an information portal managed by the World Intellectual Property Organization (WIPO) that provides comprehensive data on intellectual property from all ASEAN member states. This portal is an important step towards strengthening awareness and protection of intellectual property in the region. There have also been significant developments in the area of intellectual property in various countries in the region. Thailand has introduced an expedited examination process for trademark applications, and Vietnam has amended its intellectual property law to introduce new exceptions for copyright infringement and other intellectual property rights.

The number of intellectual property applications in the region is steadily increasing and national offices are working to harmonize application procedures and requirements. Programs such as the ASEAN Patent Examination Co-operation (ASPEC) are helping to increase efficiency. One goal is to improve online tools for easier management of IP portfolios.

To achieve its goals, ASEAN works closely with WIPO. Initiatives such as the ASEAN IP Registry and the ASEAN IP Portal provide comprehensive information and services on intellectual property. Training on IP protection and enforcement, capacity building and joint policy development are conducted in collaboration with international partners.
